Council Approvals

Town Planner Campbelltown: DA, CDC & Council Approvals

EHUP is a Sydney town planning consultancy that has taken dual occupancy, Torrens subdivision and secondary dwelling applications through Campbelltown City Council, including approvals where the lot fell short of a minimum standard. We check your site against the Campbelltown Local Environmental Plan and Development Control Plan first, free, then prepare and lodge the application and deal with council until it is determined.

Campbelltown projects we have taken through council

We work with Campbelltown City Council on the residential approvals people most often get stuck on. Three of our approved matters are published as case studies, each with its own outcome:

  • Dual occupancy and Torrens subdivision, land size shortfall: a 655m² lot, 45m² under the 700m² minimum, approved regardless. See the case study.
  • Retain one dwelling, demolish the other, build a new home and subdivide: approved despite several points of non-compliance with the Campbelltown DCP. See the case study.
  • Studio regularised as a granny flat after a council notice: approved despite a land size shortfall under the Campbelltown LEP. See the case study.

What we check first on a Campbelltown property

Before any drawings, we look at the zone, the minimum lot sizes in the LEP, the DCP controls that apply to your type of development, and any heritage, bushfire or flood overlay. Those four things decide whether your project is exempt, complying development or a full DA, and whether a variation needs to be argued. A shortfall against a minimum is not automatically a refusal, but it does need a proper planning case behind it.

Approvals most often needed in Campbelltown

Dual occupancy approval and Torrens and strata subdivision for lots that can carry two homes. Secondary dwellings and granny flats for extra rental or family space. Unauthorised use and structures where work or a use went ahead without approval. For the wider picture see town planners in Sydney.

What we take off your hands

What EHUP handles

  • Checking the zoning, Campbelltown LEP and DCP controls and any overlays on your lot
  • Confirming the right pathway (exempt, complying development or DA) before you pay for drawings
  • Preparing the planning report or Statement of Environmental Effects
  • Arguing a variation where a minimum lot size or DCP control is not met
  • Lodging through the NSW Planning Portal and responding to council's requests for information

What you don't have to deal with

  • Assuming a lot-size minimum is the end of the road before a planner has looked at it
  • Buying a property on the assumption that a studio or second dwelling can be legally rented out

Construction of Dual Occupancy and Torrens Subdivision (Land Size Shortfall), Campbelltown

Residential - dual occupancy & Torrens subdivision · Campbelltown LGA

Construction of Dual Occupancy and Torrens Subdivision (Land Size Shortfall)

Council requires a minimum of 700m² of land for a Torrens title subdivision of a dual occupancy in an R2 zone under Campbelltown City Council. The subject property comprises 655m², a shortfall of 45m². EHUP secured development approval despite this shortfall in land size.

Dual Occupancy (Retention of One of Two Existing Dwellings and Demolition of the Other, Construction of New Detached Dwelling) and Torrens Title Subdivision, Campbelltown

Residential - dual occupancy & Torrens subdivision · Campbelltown LGA

Dual Occupancy (Retention of One of Two Existing Dwellings and Demolition of the Other, Construction of New Detached Dwelling) and Torrens Title Subdivision

The owner wished to retain one of the two existing dwellings on the property, demolish the other (which was dilapidated), and construct a new detached double-storey dwelling, followed by a Torrens title subdivision of the resulting dual occupancy. EHUP was engaged and secured DA approval despite several points of non-compliance with the Campbelltown Development Control Plan.

Change of Use from Studio to Secondary Dwelling (Granny Flat), Campbelltown

Residential - secondary dwelling · Campbelltown LGA

Change of Use from Studio to Secondary Dwelling (Granny Flat)

Council issued a notice to cease use of the studio as a granny flat. The owner had purchased the property under the impression that the studio could be legally rented out. EHUP was engaged and secured DA approval despite a shortfall in the required land size for a granny flat under the Campbelltown Local Environmental Plan.

Frequently asked questions

Can a dual occupancy still be approved if the lot is under Campbelltown's Torrens subdivision minimum?

Sometimes. In one EHUP matter, a 655m² lot in an R2 zone was 45m² short of the 700m² minimum Campbelltown City Council applies to a Torrens subdivision of a dual occupancy, and development approval was still secured. Every site is different, so we assess yours before you commit to a design or a purchase.

Does EHUP lodge applications with Campbelltown City Council?

Yes. We prepare the application, lodge it through the NSW Planning Portal and handle every request for further information, so council correspondence comes to us rather than to you.

Council has told me to stop using a studio as a granny flat. Can it be fixed?

Often, yes. EHUP has secured development approval for a studio used as a granny flat after Campbelltown City Council issued a notice to cease the use, despite a land size shortfall under the Campbelltown Local Environmental Plan. Acting early is much cheaper than responding to an order later.

How do I know whether my Campbelltown project needs a DA or a CDC?

It depends on the zoning of your lot, the controls in the Campbelltown LEP and DCP, and any overlay such as heritage, bushfire or flood. We check the property itself rather than guessing from the project type, and tell you the pathway before you spend money on plans.
