We are committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
This Privacy Policy explains how we collect, hold, use and disclose personal information through the Website, including when you submit an enquiry, use the website chat assistant, create an account, or purchase an AI Planning Report (where available - see our Terms and Conditions).
1. What Personal Information We Collect
Depending on how you interact with the Website, we may collect:
- Contact information - your name, email address, telephone number, and mailing address;
- Project information - the property address or project location, and details of your planning, environmental, food safety, certification or development enquiry;
- Chat assistant messages - if you use the website chat assistant, the messages you send and, only if you choose to provide them, your name and phone number for a callback;
- Account information - if you choose to create an account, your login email and password (stored in encrypted form);
- Payment-related information - where you purchase an AI Planning Report, limited payment metadata (such as transaction reference, amount, and payment status). Your full card or account details are collected and processed directly by our third-party payment processors (see clause 4) and are not stored on our systems;
- Technical information - such as your IP address, browser type, device information, pages visited, and referring website, collected automatically through cookies and similar technologies (see clause 6); and
- Any other information you choose to provide to us, including documents, photos, or correspondence you submit with an enquiry or order.
We only collect sensitive information (as defined by the Privacy Act) where you provide it voluntarily and it is reasonably necessary for us to respond to your enquiry.
2. How We Collect Personal Information
We collect personal information:
- directly from you, when you complete a form, use the chat assistant, create an account, request a consultation, or purchase an AI Planning Report on the Website;
- automatically, through cookies and analytics tools when you browse the Website; and
- from our third-party payment processors, who provide us with limited transaction confirmation details (but not your full payment credentials) once a payment is completed.
Where reasonably practicable, we will only collect personal information about you directly from you. If we receive personal information about you from a third party, we will take reasonable steps to ensure you are made aware of the matters set out in this Policy.
3. How We Use Your Personal Information
We use personal information to:
- respond to your enquiries and provide quotes for our advisory consultancy Services;
- generate and deliver AI Planning Reports you have purchased, based on the property and project details you provide;
- process payments and manage your account (if you create one), including maintaining a record of your report/order history;
- communicate with you about your enquiry, order, or account, including sending your report, receipts, and service-related notices;
- send you marketing communications about our Services, where you have not opted out (you may opt out at any time - see clause 8);

- Payment processors - such as Stripe, PayPal, and/or other payment gateways we use from time to time, solely to process your payment for an AI Planning Report or other product;
- IT and hosting service providers - who host the Website, our databases, and store AI Planning Reports and account information on our behalf;
- Professional advisers - such as our accountants, auditors, or lawyers, where reasonably necessary;
- Government or regulatory bodies - where required or authorised by law; and
- A prospective buyer - of our business or assets, in which case we will take reasonable steps to ensure your personal information continues to be protected.
We do not sell your personal information to third parties.
5. Overseas Disclosure
Some of our third-party service providers, including payment processors (such as Stripe and PayPal), the third-party AI provider used by our website chat assistant, and cloud hosting or software providers, may store or process personal information on servers located outside Australia (for example, in the United States or other jurisdictions in which those providers operate). Where this occurs, we take reasonable steps to ensure those providers are subject to privacy and data protection obligations that are substantially similar to the APPs, including through their own published privacy policies and standard contractual protections. By using the Website and providing your personal information, you consent to this overseas disclosure.
6. Cookies and Analytics
The Website may use cookies and similar technologies (such as web analytics tools) to recognise your browser, remember preferences, and understand how visitors use the Website. Most browsers allow you to disable cookies, but doing so may affect the functionality of the Website, including your ability to complete an online purchase. We may use aggregated or de-identified analytics data to improve the Website and our Services.
7. AI Planning Reports, the Chat Assistant, and Automated Data Use
Where available, when you purchase an AI Planning Report, the property address and project details you provide are used to generate an automated report using artificial intelligence tools and publicly available planning and mapping data. We retain a record of the information you submitted and the report generated, for the purposes of order history, customer support, and compliance with our legal obligations.
Separately, the website chat assistant is also processed by a third-party AI provider in order to generate a response. If you request a callback through the chat assistant, the conversation transcript is passed to our consultants so they have the context of what you asked. Please do not enter information in the chat that you would not want recorded - for anything sensitive, call +61 419 712 406 instead.
Where we use a third-party AI or data provider to help generate reports or chat responses, we take reasonable steps to ensure that provider only uses your information for the purpose of generating your report or response and does not use it for any other purpose, such as training publicly available models, without your consent.
8. Marketing and Opting Out
If you have consented to receive marketing communications from us, you may opt out at any time by:
- clicking the “unsubscribe” link in any marketing email we send you; or
- contacting us directly at ehupconsultancy@gmail.com.
We will action your opt-out request as soon as reasonably practicable. You will continue to receive non-marketing communications related to any enquiry, order, or account you have with us (for example, order confirmations or report delivery).
9. Data Security and Retention
- We take reasonable technical and organisational steps to protect the personal information we hold from misuse, interference, loss, unauthorised access, modification, or disclosure, including secure hosting, encrypted storage of account credentials, and restricted staff access.
- We do not store your full payment card details - these are held solely by our payment processors.
- We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, or as required by law (for example, tax and record-keeping obligations), after which we will take reasonable steps to securely destroy or de-identify it.
